Terms & Conditions for Bike Bubl operatives

1. Introduction 

Welcome to Bike Bubl. These terms and conditions outline the rules and regulations for the use of our services. By accessing or using our services, you agree to comply with and be bound by these terms and conditions. 

2. Definitions 

  • Company: Refers to Bike Bubl (Franchising) Ltd.
  • Client: Refers to any individual or business that hires our services.
  • Operative: Refers to the self-employed window cleaners contracted by the Company to perform window cleaning services.
  • Services: Refers to window cleaning services provided by the Company through its Operatives. 

3. Services Provided 

  • The Company offers professional window cleaning services performed by self-employed Operatives.
  • Services include external and internal window cleaning, frame and sill cleaning, and other related services as agreed upon with the Client.  

4. Operatives 

  • Operatives are self-employed individuals contracted by the Company.
  • The Company ensures that all Operatives are adequately trained and equipped to perform the services.
  • Operatives are responsible for their own insurance, taxes, and compliance with relevant laws and regulations. 

5. Booking and Scheduling 

  • Clients can book services through our website, phone, WhatsApp, or email.
  • The Company will confirm the booking and provide an estimated time of arrival for the Operative.
  • Clients must provide access to the premises at the agreed-upon time. 

6. Pricing and Payment 

  • Prices for services are provided upon request.
  • Payment is due upon completion of the service unless otherwise agreed upon.
  • The Company accepts credit card/debit card payments only.
  • Late payments may incur additional charges.

7. Cancellation and Rescheduling

  • Clients can cancel or reschedule services up to 24 hours before the scheduled appointment without penalty.
  • Cancellations or rescheduling requests made less than 24 hours in advance may incur a cancellation fee of £50 or 50% of the cost of the service which as due to be provided, whichever is lower.

8. Liability and Insurance 

  • The Company and its Operatives will take all reasonable precautions to ensure the safety and protection of the Client’s property.
  • The Company is not liable for any damage caused by circumstances beyond its control, such as adverse weather conditions or pre-existing damage to property.
  • Operatives are required to have their own insurance to cover any potential damages or injuries. 

9. Damage Policy 

  • The Company takes every precaution to prevent damage during the provision of services. However, in the unlikely event of damage occurring:
    • The Client must report any damage to the Company within 24 hours of the service being performed.
    • The Company will investigate the claim and, if the damage is determined to be caused by the negligence or misconduct of an Operative, the Company will work with the Client and the Operative to resolve the issue.
    • Operatives are required to carry their own insurance to cover damages. The Company will facilitate communication between the Client and the Operative’s insurance provider if necessary.
    • If the damage is deemed to be pre-existing, due to a pre-existing condition or not caused by the Operative, the Company will not be liable for repair or replacement costs.
    • The Company’s liability for any damage will be limited to the cost of the service provided.

10. Specific Damage Disclaimers

  • Decorative or Structural Defects: Operatives do not accept liability for damage caused by decorative or structural defects at your property, such as, but not limited to, ill-fitting windows, doors, fascias, guttering, window/conservatory trims, unsecured windows and doors, leaking seals, loose stuck-on lead, decorative bars stuck on glass, rotting frames, flaking paint, open/broken trickle vents, etc.
  • Decorative Bars: Operatives accept no liability for decorative bars coming loose or falling from the exterior of the glass. Properly installed bars should not be damaged by our brushes. If they become loose or fall off, it is due to the adhesive losing its bond over time.
  • Scratched Window Sills: Over time, uPVC window frames may oxidize and lose color. The cleaning process may remove some of this oxidation, which may appear as scratches. This is not the responsibility of the Operative to restore the windows to their original condition.
  • Scratched Glass: The brushes used by Operatives are designed specifically for window cleaning and cannot scratch glass. If a Client believes that glass has been scratched, the Operative will demonstrate the brush’s material. If the glass is proven to be scratched by the brush, the Operative will cover the replacement cost.
  • Water Hoses: Due to previous insurance claims, Operatives will not bring water hoses through the main part of Clients’ houses. If rear access is only possible through the living area, a front windows-only service is offered.

11. Client Obligations

  •  Clients must provide accurate information regarding the property and any specific requirements or restrictions.
  • Clients must ensure safe access to the property and inform the Company of any potential hazards. 
  • Clients are responsible for securing any valuables and ensuring the safety of the work area.

12. Termination

  • The Company reserves the right to terminate the agreement with the Client at any time if the Client breaches these terms and conditions.
  • Clients can terminate the agreement by providing written notice to the Company.

13. Privacy and Data Protection

  • The Company respects the privacy of its Clients and Operatives.
  • Personal information will be collected, stored, and processed in accordance with relevant data protection laws and the Company’s privacy policy.

14. Dispute Resolution

  • Any disputes arising from these terms and conditions will be addressed through negotiation in good faith between the Company and the Client.
  • If a resolution cannot be reached, the dispute may be referred to mediation or arbitration.

15. Changes to Terms and Conditions

  • The Company reserves the right to modify these terms and conditions at any time. 
  • Clients will be notified of any changes, and continued use of the services constitutes acceptance of the revised terms.

16. Governing Law

  • These terms and conditions are governed by and construed in accordance with the laws of the United Kingdom.
  • Any legal action or proceeding arising under these terms and conditions will be brought exclusively in the courts of the United Kingdom.
